Situation with Brienna Haley Paral and Capi
It is quite unfortunate that I must take this to the public. Since Brienna Haley Paral has chosen to block me on Facebook, and refuses to communicate with me in honoring her contract with me. It is this, or take her to court, or both. I am hoping she will do the honorable thing, and behave like a mature adult, and honor our written and signed contract, and verbal agreements. If she does, then I will delete this page, and consider us on good terms. If she does not, then this page will stay up indefinitely, to warn others.
In 2015, I sold MVC Dunny's Kappachino Sunrise to Brienna Haley Paral. She had him shipped to her the beginning of May. He had just turned 3 years old, and had been with his mom, full siblings, and grandmother. He was friendly, curious, and approachable. He was halter trained, fairly recent, and he was one of the favorites at the farm by those few who visited. Kapi/Capi had a few days training with Donna Vickery, and she haltered him and tied him and got him ready to ship. Brienna Haley Paral knew this when she bought him. I have "pages" of our conversation about Kapi/Capi and details about him before she took him home.
When Kapi/Capi arrived to Brienna Haley Paral in Kewaunee,Wisconsin, after 3 days of travelling, she lunged him in a roundpen until he was drenched in sweat, and posted this on her timeline on Facebook. Almost immediately after he stepped off of the trailer. The first time he had ever even been on a trailer was when we loaded him for the hauler. He did quite well, and the hauler had no issues with him on the trip. There was no reason to round pen him. Brienna Haley Paralcontinued this practice nearly every day. She had said that he would try to climb the walls of the indoor pen trying to escape her sessions. If he got out of his fence, she was able to catch him and halter him easily, and take him back in, however, she would punish him by running him in the roundpen.
Kapi/Capi finally attacked her - biting her and picking her up. That is all that was done, and he did it one time. She was able to handle him and halter him with no issues even after he did that to her. Within 30 days, she had taken this horse, and completely changed him.
She decided to geld Kapi/Capi 30 days after having him, and within 3 months he was gelded. She waited until her three mares were confirmed in foal. She told me if I wanted to collect my AI breedings that I would have to pay for his training, or ship out 5 mares to him and have him breed them. My mares were all related to Capi - being his mother or sisters. Our contract, shown below, outlines the conditions of the sale of Kapi/Capi. this includes gelding him before allowing me time to breed him via AI. Below, you will see photos of our facebook conversation about this. The contract states that because of her decision to geld him, and her refusal to train him for AI after all, that she owed me $1100, or a deeply discounted foal.
She bred Kapi/Capi to 3 of her mares, due summer of 2016. The first mare Eka, she listed for sale while pregnant. I asked her about it and she told me she was not going to honor the contract, feeling it was void because she wanted it to be. She was also not going to honor our verbal agreement that I could have a foal of Capi's in exchange for the contracted $1100. That verbal agreement, below, shows she said that she planned on keeping Capi's foals, and if I was willing, to take one of their foals instead. I told her we would see how the foaling went this year. Eka lost her foal due to not carrying it full term. Her second mare Scarlett has had a colt. Her third mare is due near the end of July.
Brienna Haley Paral has blocked me on Facebook, and refuses to talk to me about this situation. She has Scarlett's colt listed for $1500, according to people who have inquired after the colt in genuine interest. If you look at the contract, you will see that Brienna Haley Paral has very few options. If you read our conversation, she offers me a single choice, and then takes it away. For Brienna Haley Paral to honor our contract, and our verbal agreement, she can do one of two things.
1. Pay me $1100.
2. Allow me to take Scarlett's colt Landon when he is 6-8 months old and weaned.
I am truly sorry it has come to this, Brienna Haley Paral, but if you cannot honor your contracts and agreements, you leave me with little choice. The next step, if I choose to do so, is to take you to court here in Colorado, where our contract is. This would require you to travel to Colorado for the hearing, and to discuss this with the judge. You signed the contract, I have ALL of our conversation from the very beginning. According to the contract, you would also be responsible to pay any of my expenses for court, and expenses to collect what is owed, etc. What you are choosing to do is wrong. I only ask that you do the right thing. I am disappointed in you.

Note: Capi was sold as Unregistered. Not pending. Although I do have registration in the works for his mother, making him registerable. The contract does NOT state if she is unable to care for Capi then she owes me $1100. She twists the contract to what she would like it to say rather than what it does. Capi was gelded and sold to a young man in Wisconsin. Where he was immediately used as a pack horse and is a trail horse also now. He was IMMEDIATELY able to be used as a pack horse, and the young man, to my knowledge, has had zero issues with Capi. When someone capable, and unabusive, was able to provide a home for him, the terror that Brienna Haley Paral created was gone. She turned down others interested in Capi, including breeders who wanted to give him a chance with a professional trainer before gelding him, etc. because she felt they weren't capable of caring for him, based on her experience.
